DDP or DAP: who pays the duties on your Panama shipment?

Quick Answer: Under DAP, the buyer in Panama pays duty, ITBMS and clearance on arrival. Under DDP, the seller or forwarder prepays everything and delivers tax-paid. DDP is convenient for e-commerce buyers but shifts import liability to the seller, who must have a way to recover ITBMS.

These are Incoterms 2020 rules. They apply to a 10 lb parcel exactly as they apply to a 40 ft container — most small importers just never see them named on the invoice.

DAP — Delivered at Place

The seller delivers to your address in Panama. You pay duty, ITBMS and clearance before release. The freight quote looks lower because the taxes are not in it. Commercial importers with a RUC usually prefer DAP, since ITBMS paid on imports is recoverable against output tax.

DDP — Delivered Duty Paid

The seller or forwarder prepays duty, ITBMS and the broker fee, then delivers tax-paid. Nothing is owed on arrival. The quote looks higher because it already contains the taxes. Clean for consumers, risky for sellers — the seller carries import-side liability in a country where it may have no tax registration.

Compare like with like. A DDP quote at $180 and a DAP quote at $110 are not a $70 gap if the DAP shipment then owes $83 in tax and a $45 broker fee. The DAP shipment ends up more expensive. This is where most "that forwarder is cheaper" conclusions fall apart.

DAP also exposes you to charges nobody quoted: storage at the bonded warehouse while you gather documents, inspection fees if ANA pulls the cargo, and remote-delivery surcharges to David, Santiago or Bocas del Toro. Build those into your number.

One more trap: if you buy EXW from a US supplier, you also pay inland pickup to the Miami warehouse. A supplier in Atlanta or Orlando quoting EXW has not included trucking to the consolidator. Enter that leg into the calculator so your landed cost is honest.

RVs, motorhomes, semi-trucks and heavy machinery do not fit in a container at all — they move on flat rack or RoRo vessels, and a specialist prices them after your request comes through the calculator.
